UMUNEDE (Ika weekly) – An occupant of House No. 8, Mbiri Road, Umunede, Ika North East Local Government Area, Mr. C.C. Jibunor has been given three months within which to quit the said premises.
The order was given by the President of Owa Area Customary Court, Barrister Gigi Dombraye while delivering a judgement in a suit filed by Prince Godfrey U. Mordi against Mr. Jibunor over the ownership of the House at No.8, Mbiri Road, Umunede.
In the suit, Prince Mordi had told the court that he inherited the said house from his late father, Chief John Mordi, but that his elder sister, Mrs. Comfort Jibunor, mother of the defendant has been occupying the said house since the death of their father.
He also told the court that being a male child of late John Mordi, he was asked by the family to inherit the said building by virtue of Umunede Traditional Custom.
The plaintiff told the court that when he wanted to take possession of the said building, the defendant refused, claiming that he bought the house from an Ibo man called Orizu.
Hon. Gigi Dombraye said in his judgement that he was satisfied with the evidence of the plaintiff that according to the Umunede Native Law and Custom, a female child, married to another family does not have any share in her late father’s landed property.
He therefore urged the defendant, Mr. C.C. Jibunor to vacate the building at No. 8 Mbiri Road, Umunede to allow the rightful owner, Prince Godfred Mordi take possession.
